The information produced by the Drive $marter Challenge Vehicle Savings Calculator (“the Calculator”) is for hypothetical use only and does not guarantee future automobile performance or future savings of money, gasoline, or emissions based on associated driving and vehicle maintenance tips.

The Calculator makes hypothetical calculations based on many assumptions, including information you choose to input. The calculations should not be taken as exact figures for your potential gasoline, CO2, and money savings. Driving tips are presented with an annual savings estimate, using the national average cost of gasoline at $3.78 per gallon (taken from the Department of Energy, Energy Information Administration – last updated June 10, 2008). However, many factors will affect your personal gasoline use and could cause your savings to be different, including (but not limited to): weather, terrain, carrying cargo or cargo racks, driving habits (such as quick acceleration and heavy braking), driving at high speeds, and running electrical accessories (such as air conditioning).

You acknowledge that the calculator may contain programming errors, incorrect data, or other omissions and inaccuracies. You agree not to hold the Alliance to Save Energy or the Drive $marter Challenge Partners or their officers, employees, or representatives liable for any claims arising from your use of, or any decision based on, information made available to you through the Calculator.

Without limiting the foregoing, you agree that the Alliance to Save Energy and the Drive $marter Challenge Partners will not be liable for any loss or injury resulting directly or indirectly from your use of, or reliance on, the Calculator, whether or not caused in whole or in part by the negligence of the Alliance to Save Energy or the Drive $marter Challenge Partners. You further agree that in no event shall the Alliance to Save Energy or the Drive $marter Challenge Partners be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your use of the Calculator, whether based in contract, tort, strict liability, or otherwise. You acknowledge and accept all responsibility for all activities conducted in connection with your use of the Calculator.
